You acknowledge that the ultimate decision as to whether you receive a driver's license or identification card is solely within the determination of the Washington State Department of Licensing. You further understand that the support provided in connection with this Website, including any information provided by the help desk at +1 (844) 248-8630 or the support line at support@wadlp.org, does not guarantee that your application will be successfully processed by the Washington State Department of Licensing (hereinafter referred to as the Washington DOL) or that your license will be free of any restrictions deemed necessary by the Washington DOL.

TERMINATION

The Company reserves the right to terminate your use of the Website at any time upon notice to You. Upon termination, You acknowledge and agree that the Company shall not be responsible for the content generated within the scope of the WaDLP.org.

GOVERNING LAW

This Agreement shall be deemed to have been negotiated, made and entered into in the state of Minnesota and any and all performance hereunder, or breach thereof, shall be interpreted, governed and construed pursuant to the laws of the state of Minnesota without reference to its choice of law provisions. The parties hereto hereby acknowledge and consent to personal jurisdiction and venue exclusively in Hennepin County, Minnesota (in a federal or state court of competent jurisdiction) with respect to any action or proceeding brought in connection with these Terms and Conditions. These Terms and Conditions shall be binding upon the parties, their representatives, successors, administrators, and assigns. These Terms and Conditions and the Company's rights and obligations herein may not be assigned or delegated in whole or part by either of the parties to any third party without the prior written consent of both of the parties. The parties are that of an independent contractor and are not an employee, agent or representative of the other party and this Agreement does not constitute a partnership, joint venture, agency, employee/employer, or any other similar relationship between the parties. The Terms and Conditions constitutes and contains the entire agreement between the parties with respect to the subject matter herein, supersedes all prior written or oral understandings and agreements relating thereto, and may not be changed, modified, amended, or supplemented, except by written consent of both parties. All terms and conditions of this Agreement that would, by their nature, survive the expiration or termination of this Agreement, shall so survive.

TERMS OF PURCHASE

You authorize the Company to charge your credit card for the ONE-TIME fee of $34.95. This includes customer support from our Customer Support Team and if needed, online resources to help you through your search for application forms and guidelines. We encourage You to contact our Customer Support Department first for any inquiries regarding your application process.

If you would like to charge this service to a different credit card other than the original purchase, please notify us at support@wadlp.org.

CANCELATION AND REFUND POLICY

If you are not satisfied with your packet, you may receive a refund by sending us an email at support@wadlp.org. The Company allows refunds only within sixty (60) days of purchase. No refunds will be given after sixty (60) days of the date of the last transaction by You.

FORCE MAJEURE

This Agreement shall not terminate and WaDLP.org shall not be liable for any disruption or failure to provide the services, software, or other items herein contemplated if caused by a force majeure event, act of God, war, declaration by the government, cyber and/or hostile network attacks, or other event beyond the control of WaDLP.org.

DISCLAIMER OF WARRANTIES

WaDLP.org does not warrant that the Website will operate error-free or that the Website and its server are free of computer viruses or other harmful goods. If your use of this site or its materials results in the need for servicing or replacing equipment or data, WaDLP.org is not responsible for those costs.

WaDLP.org is an "as is" and on an "as available" basis. To the fullest extent permitted by applicable law, WaDLP.org makes no representations or warranties of any kind, express or implied, regarding the use or the results of this Website in terms of its correctness, accuracy, reliability, or otherwise. The Parties further agree not to consolidate any disputes with those of other individuals or entities.

This Waiver applies to all disputes, claims, and controversies, whether based on contract, tort, statute, or any other legal theory.

LIMITATION OF LIABILITY

You further agree that WaDLP.org is not responsible or in any way liable for You failing your driver's license test. The practice exam provided through this Website is intended solely to assist You in preparing for the state administered exam. It is your responsibility to be prepared for the test. WaDLP.org makes every effort to prepare You for any question that may be on the driver's test, but it does not prepare or make the tests that are ultimately administered by the Washington DOL.

WaDLP.org shall not be held liable to You or any other person or entity for the denial of or any restriction placed on your driver's license based upon the information You provided to the questions on the application. All decisions regarding licensing are at the sole discretion of the Washington DOL and WaDLP.org has no authority or involvement with any decision made by the Washington DOL. WaDLP.org simply provides You with an easy-to-use system for understanding and applying for a driver's license.

IN NO EVENT, CIRCUMSTANCE, OR UNDER NO LEGAL THEORY SHALL WaDLP.org BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY, FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, LOSS OF GOODWILL, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS, ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES) ARISING OUT OF USE OF OR INABILITY TO USE THE WaDLP.org, WEBSITE, EVEN IF WaDLP.org HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL WaDLP.org BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE PRICE PAID TO WaDLP.org FOR THE PRODUCT.
